The Disclaimer of Veterinary Clinic Duivendrecht applies to the use of our website.

Definitions

In these General Terms and Conditions:

Treatment agreement: the agreement (of assignment) between the Veterinary Practice and the client for the performance of veterinary treatments, the supply and/or administration of medication and/or the provision of advice and/or the performance of (veterinary) examinations.

Client: the provider of the Patient on whose behalf the Veterinary Practice carries out the Treatment Agreement. If this is not the owner of the animal, he guarantees that the owner has given permission for the veterinary examination to be carried out.

Veterinary Practice: the Veterinarian(s), as well as the practice that the Veterinarian(s) conduct(s) with the use of all (auxiliary) persons, including but not limited to veterinarians, laboratory assistants, etc., whether or not on the basis of an employment contract (and) , in any legal form and/or partnership whatsoever.

Patient: the animal, the animals or the groups of animals offered for treatment by the client and/or the animal, the animals or groups of animals about which and/or for the benefit of which medicines are supplied and/or administered and/or other veterinary advice are given and veterinary services are provided.

Company

2.1 Veterinary Clinic Duivendrecht has its registered office in Duivendrecht and is registered in the trade register of the Chamber of Commerce in Amsterdam under number 77719638. “Veterinary Clinic Duivendrecht” is a trade name of a company established by M.C, Blok and M.C.M. Meppelink – Jansen driven partnership with the aim of operating the Duivendrecht veterinary practice in the broadest sense of the word.

Applicability

3.1 These General Terms and Conditions apply to all treatment agreements, including follow-up assignments, that are provided to Veterinary Clinic Duivendrecht or its employees. The applicability of other general terms and conditions is expressly excluded. These General Terms and Conditions are also stipulated for the benefit of third parties engaged by Veterinary Clinic Duivendrecht in the performance of its services and these third parties can invoke these General Terms and Conditions.

Parties

4.1 All assignments are only accepted and executed by Veterinary Clinic Duivendrecht, even if the assignment has been expressly or tacitly provided with a view to execution by a specific person. The applicability of article 7:404 of the Dutch Civil Code, which contains a regulation for the latter case, and of 7:407 of the Dutch Civil Code, which establishes joint and several liability if an assignment is given to two or more persons, is expressly excluded.

4.2 The agreement to be concluded between the Veterinary Practice and the client is only validly concluded from the moment that the agreement has been confirmed in writing by the Veterinary Practice, or when the Veterinary Practice has started to perform the agreement and/or has received the medication to be delivered. delivered and/or has administered.

4.3 If an offer to conclude an agreement ultimately does not lead to a final agreement, the Veterinary Practice is at all times entitled to charge all costs incurred by the Veterinary Practice to make the offer to the Client.

4.4 The Veterinary Practice has the right to refuse and/or only accept under certain conditions the conclusion of a Treatment Agreement with regard to a Patient offered to it for treatment, if the Veterinary Practice is of the opinion that treatment of the Patient is not or completely insufficient, has a chance of success, unless the Veterinary Practice is obliged to treat the Patient presented on the basis of statutory and/or behavioral/disciplinary regulations.

4.5 The treatment agreement concluded between the Veterinary Practice and the client is not an obligation of result and only leads to a best-efforts obligation on the part of the Veterinary Practice to provide veterinary treatment and/or advice and/or to supply and/or administer medicines in the context thereof.

4.6 The Veterinary Practice carries out the activities referred to in the previous paragraph to the best of its ability and with the care that may be expected of it.

Limitation of Liability

5.1 Any liability of Veterinary Clinic Duivendrecht is limited to the amount that is paid out in the relevant case under the professional liability insurance, increased by any applicable deductible under this insurance.

5.2 If and insofar as, for whatever reason, no payment is made under this professional liability insurance, the liability referred to above is limited to the amount required for the performance of the relevant contract.
